TERMS AND CONDITIONS

These Terms and Conditions (together with the Privacy Policy) establish the conditions of use of the website www.calyajewels.com, as well as the process of purchasing products on it.

This website is run under the name CÁLYA by Francisca Machado Costa, with the tax identification number 237926466, with the email calya.jewels@gmail.com.

When the user registers on the website, he/she must ensure that the mandatory information provided is correct and complete. The user must also inform any change in their personal data, namely postal address, email address, and other contact details.

 

PURCHASE

To place an order, the User must comply with the following procedures:

To order at www.calyajewels.com, the User must have an e-mail account and their browser must be configured to accept cookies and pop-ups, which will allow them to enjoy all the navigability conditions of the online shop.

The User may proceed to purchase products online, for which it is necessary to:

1. a) Find the product(s) you wish to purchase;

2. b) Add the selected product(s) to the "Shopping Cart";

3. c) Register the User's personal data, which will be integrated into Cálya's database under the terms provided in the Privacy Policy, including the "Delivery Address", "Billing Address", "Payment Method", telephone number and tax identification number (TIN);

4. d) Review your order and confirm the order;

You will receive an order confirmation e-mail with details of the payment method you have selected.

Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process and with the respective detailed invoice.

By submitting the order form, the User accepts the Terms and Conditions of purchase described at www.calyajewels.com , as well as the Privacy Policy.

Cálya reserves the right not to accept and cancel orders already confirmed in the following situations:

1. a) The product is not available;

2. b) Payment is not made using any of the payment options available on the website www.calyajewels.com;

3. c) Payment is not confirmed;

4. d) The billing information is not correct or verifiable;

5. e) There is an error in the price quotation;

6. f) It is not possible to deliver to the address provided by the User.

 

CUSTOMER REGISTRATION

To place an order, the User may first register by filling in the fields on the form on the website www.calyajewels.com. It is also possible to place an order without prior registration.

From the moment you access your personal account, you are subject to these Terms and Conditions.

 

AVAILABILITY OF PRODUCTS

All product orders are subject to product availability. If there is any difficulty regarding the supply of products or if there are no products in stock, the customer will be informed and the purchase price will be refunded within a maximum of 30 days.

 

PAYMENT

Payments can be made by Visa, Mastercard, Maestro, Paypal, Shop Pay, Apple Pay and Google Pay.

For Portugal, payments by Multibanco reference and MB WAY are also available.

Cálya does not accept any other payment method than those mentioned in the previous point. You must not attempt to pay by any means other than the payment methods specified. If you do so, we cannot be held liable for loss of payment or any other damages that may result.

 

PRICES AND SHIPPING COSTS

The prices of the products shown on the website already include VAT at the legal rate in force.

The prices of the products shown on the website are subject to change. Cálya reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

Shipping costs will be charged according to the values indicated on the website, calculated in particular according to the shipping method selected.

Shipments to Portugal have a cost of €3.60.

Shipments to the following countries in Europe will cost €5.90:

The customer will always be informed, in a clear and concise manner, prior to finalising the order, of the total price of the product, which includes the price, all duties and taxes, additional transport charges, shipping costs or any other costs that may exist.

 

DELIVERY

The products presented on the site are only available for delivery in mainland Portugal and the Madeira and Azores archipelagos, and in the following countries in Europe:

All orders will be delivered to the address you specified for delivery when you placed your order.

Orders will only be dispatched after confirmation of stock availability and confirmation of payment by CTT.

CALYA will make its best efforts to fulfill the delivery of the order within 5 working days from the day after receiving the payment of the purchased product.

Orders will only be dispatched on working days.

In case of impossibility to comply with the delivery time of the order, the customer will be informed of this situation, giving him the option to continue with the purchase, establishing a new delivery date, or cancel the order, with full refund of the amounts paid, within a maximum period of 30 (thirty) days from the date of knowledge of the unavailability.

 

RIGHT OF WITHDRAWAL

If, for any reason, the customer wishes to return a product, he/she may do so freely, without any penalty and without the need for justification, within 14 days of receiving the order. Exchanges, returns or cancellation of orders for items customised to the consumer's specifications will not be accepted.

The cancellation of the contract must be communicated to the email shop@calyajewels.com, and the order must be returned within a maximum of 10 days after sending the resolution email to the following address:

You must keep and present, upon return, the purchase receipt, keep the product so that you can return it in the proper conditions of use.

The refund of the amount of the returned product will be made within 15 days of the return of the product to the address indicated, to the IBAN or MBWAY indicated by the customer.

 

EXCHANGES AND RETURNS

Exchanges and returns of products can be made by email to the following address: shop@calyajewels.com

Products for exchange or return can be sent by post to the following address:

All returns must be sent by post within fourteen (14) days from the date of receipt of the order. All returned items must be in new and unused condition.

To begin the return process, the customer must send an email to shop@calyajewels.com to communicate their desire to return or exchange their order. 

To return an item, the customer must place it safely in its original packaging and send their return to the following address:

The customer will be responsible for the return shipping costs, if it is more convenient for you to leave the item in one of our resellers in Guimarães or Famalicão, you must mention it via email.

Upon receipt of the return and respective inspection of the condition of the item, the process of returning or exchanging the order will be initiated. The customer must wait at least five (5) days from receipt of the item for the return or exchange to be processed. The customer will be notified by e-mail when their return has been processed. 

If the customer wishes to exchange the item, they must indicate in the email which product they wish to receive, and the exchange is limited to the stock existing at the time.

The exchanged items will be sent in a free delivery service. The customer must wait up to five (5) working days for their exchange to be processed. In the event of a problem, CALYA will contact the customer via telephone (if provided) or via email.

 The following items cannot be returned or exchanged:

- Personalised / bespoke items (Example: Pendants with initials or names etc).

- Items on SALE are declared as final sale, so cannot be returned.

The customer must keep and present, when exchanging the product, the purchase invoice and must keep the product in order to be able to return it in the proper conditions of use.

 

RETURNS OF DEFECTIVE PRODUCTS

CALYA guarantees the conformity of goods purchased on the Website in accordance with the provisions of Decree-Law no. 67/2003, of 8 April, as amended by Decree-Law no. 84/2021, of 18 October.

To this end, it is necessary that the non-conformity of the purchased product manifests itself within a maximum period of 3 (three) years from the delivery of the same ("Guarantee"), within which in the first 2 (two) there is a presumption of existence of the non-conformity of the good at the date of delivery of the same. After the two (2) years have elapsed, it is up to the customer to prove that the lack of conformity existed at the time of delivery of the goods.

The delivery of the product for the purpose of return can be made, upon presentation of the respective invoice by post to: Rua da Poça do Pisco, Nº 429, Vila Nova de Famalicão, 4760-131, Portugal.

CALYA will repair, deliver a new product or refund, partially or totally, depending on the customer's choice, as soon as possible and always within a maximum period of 30 (thirty) days.

In the event of a choice to terminate the contract, the amount paid for the goods will be refunded, as well as the delivery costs and, if applicable, the return costs. 

The refund of the amount will be made to the IBAN or MBWAY indicated by the customer for this purpose.

Defects or malfunctions resulting from improper use of the products purchased, failure to comply with the instructions accompanying the products or resulting from repairs carried out by unauthorised third parties are excluded from the scope of the guarantee. 

 

PROPERTY

All copyright, trademark and other intellectual property rights in the materials or content that are provided as part of the website are at all times owned by CALYA or the licensor and you may only use such material in the manner expressly authorised by you.

 

CUSTOMER COMMUNICATIONS

By using this website, you agree that notices sent by CALYA will be sent electronically to the email address provided by you.

APPLICABLE LAW

All questions concerning the application or interpretation of these Terms & Conditions, as well as any dispute arising from the interpretation, validity or breach of the contract concluded between the parties, shall be subject to the competent Portuguese courts.

Portuguese law shall apply to such disputes, expressly waiving any other.

 

RESOLUTION OF DISPUTES

In the event of dissatisfaction with the purchase of the product or the service provided on the website, the customer may also, without prejudice to the right to submit the dispute to the consideration and decision of a judicial court, resort to one of the Alternative Dispute Resolution Entities listed on the consumer portal, on the website www.consumidor.pt, or Online Consumer Dispute Resolution identified on the website https://webgate.ec.europa.eu/odr.

These Terms and Conditions may be amended at any time, in which case we will publish an updated version on the website. The use of the website as well as the placing of any order after CALYA has published a new version of the Terms & Conditions will be subject to the version of the Terms & Conditions in force, which must be expressly accepted prior to submitting the order.
